General Terms and Conditions (GTC)
1. Scope
Beluga Kids is a company of UNIQ Marketing & Retail GmbH based in Egg near Zurich (hereinafter Beluga Kids) and includes an online shop for children's items with a sense of design, quality and sustainability. These general terms and conditions apply to all orders placed on the website https://belugakids.ch, https://belugakids.shop, https://belugakids.de in the version current at the time of the order.
2. Order and conclusion of contract
By placing an online order, you agree to these GTC. The contract is concluded by clicking on the "BUY" button and the subsequent order confirmation by email. This creates a legally binding purchase contract.
3. Our delivery and sales conditions
After receiving the order confirmation, we will send the ordered items as a package to the delivery address you provided.
- Unless otherwise stated under "Delivery time", the usual delivery time for standard shipping is 2-4 working days and 1-2 days if you select priority shipping (if you order before 12 noon).
- For orders from abroad, the delivery time can be extended by up to 15 working days.
- If the delivery of the goods fails despite several delivery attempts, we are entitled to withdraw from the contract. In this case, any return costs are borne by the buyer.
4. Offer
Our online offer is subject to change and non-binding. The items offered in the online shop are generally available. If it is not possible to deliver one or more items due to a stock discrepancy, Beluga Kids will inform you of this as soon as possible and offer you equivalent items or a subsequent delivery. If none of these items suit you, the amount will be refunded.
5. Prices
All prices quoted are ex warehouse in Swiss francs (CHF) and include statutory VAT (if applicable). Shipping costs and any customs duties (for deliveries abroad) are not included in the prices quoted, unless expressly stated otherwise.
6. Your shopping account
For orders in our online shop, you can use the payment options listed there. When you make your first purchase, we will open a shopping account for you - provided that the credit check is positive - through which all purchases, payments and credits will then be processed on an ongoing basis.
7. Delivery and shipping
7.1. Scope
We deliver worldwide.
7.2. Shipping costs
For our delivery throughout Switzerland and the Principality of Liechtenstein, you pay a shipping fee of CHF 7.90 (Economy). For orders with a goods value of over CHF 120.00, there are no shipping costs. For the additional option "Express delivery", you will be charged a flat rate of CHF 9.80 regardless of the goods value.
For deliveries abroad, we charge a shipping fee depending on the delivery country and the order weight. Any returns due to uncollected or rejected shipments are at the buyer's expense.
7.3. The kickbag
We deliver using the reusable kickbag if possible due to the product. The return shipping costs are at Beluga Kids' expense. If the item is not returned after a reminder email, you will be charged 5 francs per kickbag.
8. Customs & import fees
For deliveries outside Switzerland, prices are shown as net amounts (excluding 8.1% VAT). You will be charged the applicable VAT when clearing customs. Any customs duties or other import fees charged by third parties are at the recipient's expense.
9. Payment options
For orders within Switzerland and the Principality of Liechtenstein, you can pay by credit card, PayPal, Apple Pay, Twint or invoice.
9.1 Invoice with installment/partial payment option (POWERPAY)
MF Group / POWERPAY, as an external payment service provider, offers the payment method “purchase on account”.When the purchase contract is concluded, POWERPAY takes over the invoice claim and handles the corresponding payment terms. You have 30 days to pay your invoice. You can choose whether you want to pay immediately, a little later, all at once, or in installments.If you do not pay within the specified time frame, you will receive a monthly invoice with an order overview in the following month.When purchasing on account, in addition to our general terms and conditions, you accept the General Terms and Conditions of POWERPAY.Orders from abroad can only be paid by credit card or PayPal.
9.2 E-Payment
You can also pay for your order by credit card (VISA, Mastercard, AmericanExpress), PayPal, ApplePay via the secure Payment system Stripeor Twint Switzerland. Any fees charged by the card institutes will be charged to you.
9.3. Late payment
In the event of late payment, we are entitled to charge you default interest of 10% per year plus a fee of CHF 20.00 from the 2nd reminder. Reminders and invoices are sent by email. In the event of late payment, Beluga Kids is also entitled to assign the debtor's claim and costs to third parties. The right to claim further damages remains reserved. This regulation does not apply to purchases on account via powerpay.
10. Voucher
Gift vouchers are vouchers that you can purchase. You can pay for your order with a voucher from Beluga Kids. To do this, enter the code on the voucher in the corresponding field in the order. A gift voucher can only be redeemed before the order process is completed.
The amount of the voucher is specified. The vouchers are only issued in CHF and are freely transferable. Cash payment is not possible.
11. Promotional vouchers
Promotional vouchers are issued as part of advertising campaigns and cannot be purchased.
- They can only be redeemed during the specified period and under the conditions stated there (e.g. only once per person).
- Individual products may be excluded from voucher promotions.
- The voucher value will only be credited if the value of the goods is at least equal to the voucher amount.
- Cash payment or interest on promotional vouchers is excluded.
- In the event of returns, Beluga Kids reserves the right to charge you the original price of the goods kept if the total order value falls below the voucher value after cancellation.
12. Retention of title
The ordered goods remain the property of Beluga Kids c/o UNIQ Marketing & Retail GmbH until full payment has been made.
13. Right of withdrawal/right of return
In Switzerland, there is no legally prescribed right of withdrawal under the Swiss Code of Obligations (OR). Beluga Kids therefore offers its customers a voluntary right of return of 14 days after receipt of the goods in order to make the purchase customer-friendly.
13.1 Return costs:
Returns are always at the buyer's expense. For orders within Switzerland, we provide a return label via the customer account for a flat fee of CHF 7. However, Beluga Kids reserves the right to refuse to pay this flat rate.
13.2 Return process:
The return must be clearly identifiable using the sender's details so that a refund can be made.
13.3 Refund fee:
For returns outside the 14-day period or for non-conforming goods, we expressly reserve the right to charge a refund fee of20% of the item value. In some cases, Beluga Kids reserves the right to charge a flat fee if the return does not meet the agreed conditions.
13.4 Condition of the goods:
Unused, unworn and undamaged items must be returned in the original, undamaged packaging.
13.5 Shipping costs deduction:
For orders with a total value of less than CHF 120.00, the original shipping costs (CHF 7.90) will be retained when making the refund.
13.6 Exceptions:
Bulky goods, furniture, hygiene items, second season and Give-A-Chance (2nd choice) are excluded from the right of return. Article.
13.7 Cancellation option:
In the event of a cancellation, you have the choice between a voucher or a refund of the purchase amount (minus the shipping costs and any down payment fee retained).
14. Delivery defects
We ask you to check the delivered items immediately for correctness, completeness and integrity. Complaints regarding delivery scope, material defects, incorrect deliveries and quantity discrepancies must be reported to us in writing within 5 working days of receipt of the goods. The defect will be checked immediately by Beluga Kids. If the defect is accepted by Beluga Kids, you will receive an identical replacement item, if available, and the shipping costs will be refunded. Otherwise, a partial credit or full credit will be paid to your account.
15. Warranties
The warranty for the items sold by Beluga Kids is based on the statutory provisions and the assurances of the respective manufacturer. In the event of improper handling or interference with the product structure, the warranty claim expires.
16. Consent to the General Terms and Conditions for Product Rental Agreements
By accepting these General Terms and Conditions, the Buyer/Tenant expressly declares that he has carefully read, understood and fully accepted the "General Terms and Conditions for Product Rental Agreements" of Beluga Kids c/o UNIQ Marketing & Retail GmbH. These terms and conditions govern the rental of the products, including, but not limited to, the obligations of the renter, rental period, termination conditions, payment terms, liability and return of the rented products. The Buyer/Tenant hereby confirms his consent to these terms and conditions and acknowledges that they are an integral part of the rental agreement. An order or acceptance of the rental products by the Buyer/Tenant from Beluga Kids is considered irrevocable consent to these terms and conditions.
16.1 Obligation to review
The Buyer/Tenant confirms that he has been given sufficient opportunity to review the "General Terms and Conditions for Product Rental Agreements", ask questions and obtain clarifications. The buyer/tenant understands that if there are any uncertainties or questions about the terms and conditions, Beluga Kids must be contacted before accepting these terms and conditions.
17. Data protection
The protection of your personal data is very important to us. We comply with the applicable data protection regulations and protect your data against unauthorized access by third parties (data security precautions).
Our online shop is encrypted using SSL (Secure Socket Layer), which means that all data in the offer as well as your payment and customer data are transmitted securely to us.
Beluga Kids is entitled to use your personal data to send you special offers or information about new collections. You can revoke your consent to the use of your personal data for advertising purposes at any time by sending an email to.
We protect our website and other systems through technical and organizational measures against loss, destruction, access, modification or distribution of your data by unauthorized persons. Access to your shopping account is only possible after entering your personal password.
This website contains a Facebook/Instagram & Pinterest button. By activating the button you come into direct contact with the respective social networks. Facebook, Instagram or Pinterest use the personal data of its users in a manner that may not be compliant with data protection regulations, as insufficient information is provided about the use of the data. Beluga Kids c/o Werbeloggia Masullo is not liable for any damage caused to you by Facebook misusing your personal data.
